Tort law and product liability

Tort refers to a wrong which can be compensated under the law. Tort can be classified under various categories such as negligence, personal injury, nuisance, product liability, competition law, defamation, etc. Negligence is the most prevalent action in tort used for claiming damages for bodily injury or to protect the property. Under the Personal injury law one can pursue legal action where any injury is caused by negligence, recklessness, malpractice or inaction of others such motor vehicle accidents, worker’s compensation, product liability, medical malpractice etc. Torts such as nuisance refer to strict liability of the neighbour who interferes with another’s enjoyment of property. Trespass can be used for initiating action against people for deliberately entering the land/ house of another person etc.
The following are the essential elements for an act (or inaction) in order to initiate any legal action in tort:

  • there must be a legal duty of care to another person;
  • there must be a breach of that duty;
  • the claimant must have suffered damages, and
  • the damages must have been proximately caused by the breach of duty.
